Grocery Store, Drug Store, Restaurant, and On-Demand Delivery Service Employee Protections
At today’s Government Audit and Oversight Committee meeting, Supervisor Haney’s Emergency Ordinance, “Grocery Store, Drug Store, Restaurant, and On-Demand Delivery Service Employee Protections”, was amended and passed unanimously. This legislation was introduced to provide additional protections to essential employees in order to ensure their health and safety. At the meeting, the legislation received extensive public support from labor advocacy organizations like SEIU 1021, SF Labor Council, and from workers in the industry. In his ending comments, Supervisor Haney also articulated that the Board of Supervisors stand united in support of AB5 and was assertive in seeing company compliance surrounding this legislation.
Amendments discussed:
- Strikes “hourly” in: “Further, by providing additional scheduling flexibility and hours protections, this emergency ordinance provides grocery store, drug store, restaurant, and on-demand delivery employees additional tools to protect themselves and others from infection and thereby protect public health.”
- Makes more explicit the definition for on-demand delivery service platforms as anything that is third-party, online, or mobile delivery services that has scheduled deliveries.
- Eliminates the section offering additional work to part-time employees, meaning that before an employer can hire new employees or use contractors for temporary services they would first have to offer it to current temporary workers.
- Allows an individual to report a violation of this ordinance by calling the City’s 311 and the relevant City agencies can investigate for enforcement.
As for next steps, this item will go forth with a positive recommendation to the Board of Supervisors. It is currently slated to be heard on Tuesday, April 21st for a first and final reading, as this is an emergency ordinance.
Public Health Emergency Leave Ordinance
Supervisor Mar’s Emergency Leave Ordinance surrounding paid sick leave passed at the Board of Supervisors meeting on April 14th and is now at the Mayor’s Office to be signed, where it will be codified into law. A previous members update stated this legislation was to be heard at next week’s Board of Supervisors meeting for a final reading, however, as Supervisor Mar’s legislation was an emergency ordinance, it will follow the legislative track outlined above.
“Right to Return to Work” Legislation
Two weeks ago, Supervisor Mar telegraphed he would be introducing legislation that would address workers who were laid off during this emergency to ensure they would be the first to be offered their jobs back once business and the economy were healthy again. Supervisor Mar did not address this further at this week’s meeting and is expected to introduce this legislation at next week’s meeting. Rest assured, we will continue to monitor this item as additional details emerge.
