Required Legislation Referrals

Small Business Commission (Board of Supervisors Motion No. 01-33)

  • Commission has 12 days from the date of referral to provide a recommendation
    • Once the 12 days has lapsed the BOS can go forward with action, with or without response

Youth Commission (Charter, Section 4.124)

  • Commission has 12 days from the date of referral to provide a recommendation
    • Once the 12 days has lapsed the BOS can go forward with action, with or without response

Planning Department (Board Rule 3.23)

  • Referral required​for all Administrative Code amendments that pertain to planning or land use matters.
  • Commission has 30 days to provide a recommendation. If no response is received, the BOS can go forward with hearing.

Planning Commission – Planning Code, Section 306.4(d)(3))

  • Recommendation required​for all Planning Code and Zoning Map amendments
  • Commission has 90 days to provide a recommendation or it is deemed disapproved
    • The Board of Supervisors can extend this deadline by Resolution

Historic Preservation Commission​(Charter, Section 4.135)

  • Recommendation required​for all historic and landmark ​matters
    • No time limit for their response

Building Inspection Commission (Charter, Section D3.750-5)

  • Recommendation required​for all Building, Electrical, Housing, Plumbing, and Mechanical Code amendments
  • No time limit for their response

Ethics Commission (Campaign and Government Conduct Code, Section 1.103)

  • Positive recommendation required for amendments to Article 1, Chapter 1, of the Campaign and Government Conduct Code.
  • No time limit for their response

Liquor Licenses (California Business and Professions Code, Section 23958.4)

  • Responses required from 1) Planning Department and 2) Police Department for all public convenience or necessity (PCN) requests for liquor licenses.

Street Name Changes (California Government Code, Section 34091.1, and California Streets and Highways Code, Sections 970.5 & 5026)

  • Responses required from 1) Department of Public Works, 2) Police Department, 3) Municipal Transportation Agency, and 4) Fire Department for all street name change requests, including public right-of-ways, sidewalks, plazas, pathways, and stairways.
